JECT Clinics B.V., established in Amsterdam and registered with the Chamber of Commerce under number 91612624. JECT Clinics is also understood to mean the certified medical practitioners working there or third parties hired by JECT Clinics.
Client: the natural person and client aged 18 years or older who enters into a treatment agreement with the service provider.
Service Provider: the legal entity offering services to Client, hereinafter referred to as JECT Clinics
Offer: Any written offer to Client to perform Treatments by JECT Clinics.
Treatments: the treatments offered by JECT Clinics are filler and botox treatments as well as treatments for the purpose of skin improvement.
Assignment: the execution of the treatment agreement by JECT Clinics regarding the treatment(s) requested by the Client.
These General Terms and Conditions apply to every offer by JECT Clinics, every treatment agreement between JECT Clinics and Client and every service offered by JECT Clinics. Deviation from these General Terms and Conditions is in principle not possible. In exceptional situations it is possible to deviate from the General Terms and Conditions if this has been agreed explicitly and in writing with JECT Clinics. These General Terms and Conditions also apply to additional, amended and follow-up assignments with Client. The applicability of Articles 7:404 and 7:407 paragraph 2 of the Dutch Civil Code is explicitly excluded.
The agreement is established at the moment that Client gives an order to JECT Clinics to carry out one or more treatments. Client can only enter into a treatment agreement if it has been established that Client:
Has reached the age of 18 years and has presented a valid identification document to that effect;
Prior to the treatment agreement has been clearly and comprehensively informed about the treatment, the possible risks and consequences, any expected result, aftercare of the treatment, cost of the treatment and method of payment and the reflection period to reach a reasonable decision, time of treatment;
In the event of supervision, shelter and/or outreach, Client follows instructions.
Is aware of the contact person at JECT Clinics in case of complications, and contacts immediately as discussed during instructions.
Completed the treatment form completely and truthfully (anamnesis form);
All questions about treatment have been asked and answered.
JECT Clinics will provide a statement of the costs involved in the treatment prior to the conclusion of the agreement. The costs of continued treatment and aftercare are not included, unless otherwise stated or JECT Clinics' duty of care dictates otherwise. By agreeing to the agreement, the Client agrees and undertakes to pay the cost of treatment.
All offers made by JECT Clinics are without obligation, unless expressly stated otherwise in writing. JECT Clinics has the right to refuse treatment subject to legal and/or behavioral and/or disciplinary regulations. JECT Clinics has the right to refuse an agreement without giving reasons. Such refusal does not entitle Client to compensation or any other compensation for refusing treatment. The Client is obliged at all times to follow the house rules and reasonable instructions of JECT Clinics.
The doctors of JECT Clinics may use registered medications and other medical devices during treatment. JECT Clinics' treating physicians act in accordance with the duties of care incumbent on them as a good contractor, as well as the requirements and guidelines that apply in accordance with the professional standard of the profession. JECT Clinics keeps a file relating to the Client's treatment. In this file data is collected regarding medication use, the treatment(s) carried out, results, complaints and other relevant information.
Client is obliged to cooperate at the first request of JECT Clinics. In case of illness, use of medication or other circumstances that may be relevant to the possible implementation of treatment, this must be discussed in advance with the doctor concerned. Client must inform JECT Clinics as soon as possible if Client is unable to keep an already scheduled appointment.
Unless agreed otherwise, treatment costs will be calculated on the basis of rates or prices set unilaterally by JECT Clinics. The prices shown must be paid preferably by Pin at JECT Clinics' location after the treatment has taken place. Client cannot derive any rights or expectations from a budget issued in advance, unless the parties have explicitly agreed otherwise.
JECT Clinics will handle Client's (personal) data with care and will only use them in accordance with the privacy statement. If requested, JECT Clinics will inform the person concerned about this. Questions about the processing of personal data and further information can be addressed by e-mail to info@jectclinics.nl. If JECT Clinics must provide security of information on the basis of the Agreement, this security will comply with the agreed specifications and a security level that is not unreasonable in view of the state of the art, the sensitivity of the data, and the costs involved.
JECT Clinics is insured for the risk of (professional) liability. JECT Clinics is insured for the risk of (professional) liability. The liability of JECT Clinics is limited to direct damage and to the amount paid out under the liability insurance in the case in question (increased by the amount of the detroughible applicable under the insurance that is not borne by the insurer according to the policy conditions), with a maximum equal to the treatment costs charged or to be charged. Compensation of indirect damages, including in any case but not exclusively side effects and consequential damages, is excluded at all times.
JECT Clinics and Client undertake to keep confidential all confidential information obtained in the context of an assignment. No Client data will be provided to third parties without Client's prior written consent. The obligation of confidentiality does not apply if the law requires disclosure of certain data. JECT Clinics is entitled to use the information obtained for statistical purposes. JECT Clinics will thereby ensure at all times that the information cannot be traced back to the individual Client.
All IP rights and copyrights of JECT Clinics rest exclusively with JECT Clinics. It is prohibited to disclose and/or reproduce, modify or make available to third parties any documents subject to the IP rights and copyrights of JECT Clinics without the express prior written permission of JECT Clinics. JECT Clinics is authorized to post images made of Clients who have undergone treatment on its social media channels for its own promotion, after explicit permission from Client.
If Client is not satisfied with the service and/or execution of the treatment agreement of JECT Clinics, Client is obliged to report these complaints as soon as possible, but at the latest within 2 weeks after the relevant reason that led to the complaint. A complaint does not entitle the Client to publicly attack (or have attacked) the honor and good name of JECT Clinics. For violation of the provisions of the previous paragraph, the Client will forfeit to JECT Clinics an immediately claimable fine of €100 per statement and €100 per day that the violation continues.
